Welcome to CostAnchor. These Terms of Service ("Terms") govern your access to and use of the CostAnchor website, application, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Description of Service
CostAnchor provides an automated, AI-assisted platform designed to extract, organize, and analyze data from construction field reports, schedules, and contracts.
2. AI Fallibility and Limitation of Liability (Important)
CostAnchor is an organizational and informational tool, not a licensed professional. The Service utilizes artificial intelligence (AI) to parse unstructured text. While we strive for high accuracy, AI can occasionally misinterpret data, miss context, or generate incorrect summaries (hallucinations).
By using CostAnchor, you explicitly acknowledge and agree to the following:
- CostAnchor is not a licensed engineer, architect, safety inspector, or legal counsel.
- The Service does not replace human oversight, professional judgment, or mandatory site safety inspections.
- You (the General Contractor, Project Manager, or User) retain 100% of the liability for actual job site safety, structural integrity, schedule management, and legal compliance.
- CostAnchor shall not be held liable for any missed risks, project delays, financial losses, or safety incidents resulting from reliance on the Service's automated outputs. You must independently verify all AI-generated briefs and flagged risks.
3. Account and Workspace Responsibilities
To access the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials (managed securely via our authentication provider) and for all activities that occur under your account or within your assigned General Contractor workspace.
4. Fair Use Policy
To ensure high performance and reliability for all users, CostAnchor operates under a Fair Use Policy. The standard Growth Tier subscription is designed to support the daily reporting needs of typical construction projects (e.g., up to 150 field report analyses per month, per workspace).
If a workspace's usage significantly exceeds normal volumes or utilizes automated scripts to flood the API (the "Magic Mailbox"), CostAnchor reserves the right to temporarily throttle processing speeds or require the workspace to upgrade to a custom Enterprise pricing plan to cover the excess computing costs.
5. Subscriptions, Payments, and Refunds
Billing: CostAnchor is a paid service billed on a monthly recurring subscription basis. All payments are processed securely through our third-party payment processor (Stripe). We do not store your credit card information.
Cancellations: You may cancel your subscription at any time through your Project Settings. Cancellation will take effect at the end of your current paid billing cycle.
Refunds: Because we incur hard computing costs (API and server usage) the moment you process reports, subscriptions are strictly non-refundable. We do not provide prorated refunds for partial months of service.
6. Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, abuses our API, or is harmful to other users of the Service, us, or third parties.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
